A court date has been set for the appeal of the sentence handed to former NSW Police officer Kristian White (pictured above right), who was convicted of the manslaughter of 95-year-old Clare Nowland (pictured above left) last month.
The NSW Court of Criminal Appeal will hear the case on 27 June, following a challenge by prosecutors who argue that the sentence – a two-year community correction order – is inadequate.
White was found guilty in November last year over the tasering of Mrs Nowland at Yallambee Lodge aged care facility in Cooma, 114km south of Canberra, in May 2023.
The great-grandmother, who had dementia, fell and suffered a fatal brain injury after being tasered by White. Mrs Nowland died a week later in hospital.
Justice Ian Harrison ruled in March that White’s actions were at the “lower end” of the scale of seriousness for manslaughter, and that jail time would be “disproportionate.”
However, the Director of Public Prosecutions quickly announced plans to appeal the sentence, citing concerns over its leniency.
White, 35, is currently living under the conditions of the community correction order while awaiting the outcome of the appeal.
