“Employers should prepare for imminent requests”: MinterEllison on supported bargaining in the aged care sector

Law firm MinterEllison has responded to The SOURCE’s questions about supported bargaining, which came into effect on 6 June 2023.

Supported bargaining is a type of multi-enterprise agreement. With the Secure Jobs, Better Pay Bill aged care representative, the unions, can make an application to combine aged care employers into a multi-employer agreement.

“There are more options for employees and their representatives to commence bargaining,” Minter Ellison’s Deanna McMaster, Sarah Walters, Claire Fung, and Chelsea Simmons said.

Now that the new arrangements are in place, aged care employers should have an industrial relations strategy and watch the Fair Work Commission (FWC) decision closely.

Aged care unions are already “active in seeking wage increases”, MinterEllison wrote. “We anticipate that employees and their representatives will continue to advocate for higher wages including during single and multi-enterprise bargaining.”
