Family of Tasered aged care victim Clare Nowland sues NSW Government

The lawyer representing the family of Clare Nowland, who died from injuries she suffered after being allegedly Tasered by a NSW Police officer at Snowy Monaro Regional Council’s Yallambee Lodge aged care facility, said the family first made the civil claim while she was still alive.

The 95-year-old great-grandmother was allegedly Tasered by a police officer in the aged care home in Cooma in the NSW Snowy Mountains on 17 May, causing her to fall and fracture her skull. She died at Cooma Base hospital a week later.

“The proceedings were filed to protect Clare's legal rights in circumstances where in that point in time she was still alive, it has to be borne in mind that this is not the family pursing the government,” lawyer Sam Tierney told Nine Network.

The Aged Care Quality and Safety Commission (ACQSC) is investigating the incident and the police officer allegedly involved, Senior Constable Kristian White, has been charged with causing bodily harm.

The civil case was adjourned to 22 August in Bega District Court on 11 July for a pre-trial conference.
